Terms of Service

These Terms of Service (the “Terms”) are an agreement between you and AskZoye. By creating an account or using the service, you agree to be bound by them. Please read them carefully — and if anything is unclear, email legal@askzoye.com.

1. Agreement and eligibility

These Terms govern your access to and use of AskZoye's websites, dashboards, chat widget, APIs, and related services (collectively, the “Service”). By signing up or using the Service, you confirm that you are at least 18 years old, have the authority to enter into these Terms on behalf of yourself or the business you represent, and are not located in a country subject to a comprehensive embargo by your or our jurisdiction.

If you are accepting these Terms on behalf of an organization, “you” and “your” refer to that organization. You represent that you have the authority to bind it.

2. Your account

To use AskZoye you need an account. You agree to provide accurate information, keep it up to date, and keep your login credentials confidential. You are responsible for everything that happens under your account, whether or not you authorized it. Notify us immediately at security@askzoye.com if you suspect unauthorized access.

3. Plans, credits, and billing

AskZoye offers two billing models:

  • Subscription plans (Starter, Pro, Business) billed monthly or annually. Each plan includes a set number of AI conversations per billing period.
  • Pay-as-you-go credits at $0.10 per conversation. Credits are charged when purchased and consumed as conversations occur.

Subscriptions automatically renew at the end of each billing period unless you cancel. You can cancel at any time from your dashboard, and the cancellation takes effect at the end of your current period — you keep access until then. Pay-as-you-go credits expire 12 months after purchase.

Prices are listed in US dollars, except in Pakistan where Safepay processes payments in PKR. Applicable taxes (VAT, GST, sales tax) may be added at checkout. If a payment fails, we will retry and notify you. Accounts that remain unpaid after 14 days may be suspended; after 60 days, data may be deleted.

4. Refunds and cancellation

We want you to be happy with AskZoye. If something isn't right within the first 7 days of a new subscription, contact support@askzoye.com and we will work with you on a refund in good faith. After that, subscription fees are non-refundable except where required by law.

Pay-as-you-go credits are refundable while unused, within 30 days of purchase. Credits that have already been consumed cannot be refunded. If you initiate a chargeback without contacting us first, we may suspend your account immediately.

Consumers in the EU and UK retain any statutory cancellation and refund rights available under their local law.

5. Your data and our license

You retain all rights to the data you and your customers provide to AskZoye (“Customer Data”). We do not claim ownership of your store catalog, chat transcripts, or any content you upload.

You grant AskZoye a worldwide, non-exclusive, royalty-free license to host, copy, transmit, display, and process Customer Data solely as needed to provide and improve the Service, including by sending relevant content to our LLM subprocessors to generate responses.

We may use aggregated and de-identified information — data that cannot reasonably be used to identify you, your business, or any individual — to operate, secure, and improve the Service. We do not use identifiable Customer Data to train any AI model, and our LLM providers are contractually prohibited from doing so on the endpoints we use.

6. Acceptable use

You agree not to use AskZoye to:

  • Violate any law or third-party right, including intellectual property rights
  • Send spam, phishing, malware, or other unsolicited or harmful content
  • Generate content that is illegal, harassing, defamatory, sexually explicit involving minors, or that incites violence or hatred
  • Provide medical, legal, or financial advice without clear disclaimers and qualified human review
  • Attempt to bypass safety measures, prompt-inject the AI, or extract our system prompts
  • Reverse engineer, decompile, scrape at scale, or use the Service to build a competing product
  • Interfere with the Service's infrastructure, run vulnerability scans without written permission, or attempt to gain unauthorized access

We may suspend or terminate accounts that violate these rules, with or without notice depending on the severity.

7. AI outputs and your responsibilities

AskZoye uses large language models that generate responses probabilistically. AI outputs may be inaccurate, incomplete, biased, or out of date. They should not be treated as professional advice, and you should not rely on them for decisions that could harm your customers or business.

As the merchant, you are responsible for:

  • The data you connect (your product catalog, policies, knowledge base) and keeping it accurate
  • Configuring AI behavior and reviewing how the assistant represents your brand
  • Disclosing to your end customers that they are interacting with AI, where required by law (including the EU AI Act)
  • Compliance with consumer protection, advertising, and product-information laws

8. Our intellectual property

AskZoye and its licensors own all rights, title, and interest in the Service, including the platform software, dashboards, chat widget, brand, trademarks, and documentation. These Terms do not transfer any of those rights to you. You may use the Service only as expressly permitted under these Terms.

If you give us feedback, suggestions, or ideas, you grant us a perpetual, worldwide, royalty-free license to use them without restriction or compensation.

9. Third-party services

AskZoye integrates with Shopify, WooCommerce, OpenAI, Anthropic, Paddle, Safepay, and other third-party services. Your use of those services is governed by their own terms, and we are not responsible for their availability, behavior, or policies. If a third-party service changes or becomes unavailable, we may need to modify or discontinue related features of AskZoye.

10. Service availability

We work hard to keep AskZoye available and reliable, but we do not guarantee uninterrupted access. The Service may be unavailable from time to time due to scheduled maintenance, upstream provider outages, or events beyond our control. We are not liable for any downtime, and we do not offer service credits except where explicitly stated in a separate written SLA.

11. Warranty disclaimer

Except as expressly stated in these Terms, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory. AskZoye disclaims all implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service or AI outputs will be accurate, uninterrupted, secure, or error-free.

12. Limitation of liability

To the maximum extent permitted by law, AskZoye and its officers, employees, and subprocessors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of the Service — even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or related to these Terms or the Service is limited to the greater of (a) the fees you paid us in the 12 months immediately before the event giving rise to the claim, or (b) USD 100.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the smallest extent permitted by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless AskZoye and its team from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of: (a) your use of the Service in violation of these Terms or applicable law; (b) your Customer Data or the way you have configured the AI; or (c) any claim brought by an end customer relating to your business, products, or services.

14. Confidentiality

Each party may receive non-public information from the other (“Confidential Information”). The receiving party will use the same degree of care it uses to protect its own confidential information, and at least a reasonable degree of care, to prevent unauthorized use or disclosure. This obligation continues for three years after termination, except for trade secrets, which remain protected as long as they qualify as such.

15. Suspension and termination

You can stop using the Service and cancel your account at any time from the dashboard. We may suspend or terminate your access to the Service if you materially breach these Terms and do not cure the breach within 30 days of notice, if you fail to pay, or immediately if your activity poses a security or legal risk.

On termination, your right to use the Service ends. We will keep your data accessible for 30 days so you can export it, after which it may be permanently deleted (subject to backups and any legal retention obligations described in our Privacy Policy).

16. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and update the “Last updated” date at least 30 days before the changes take effect. If you do not agree with the updated Terms, you may cancel your account before they come into force. Continued use of the Service after that date means you accept the new Terms.

17. Governing law and disputes

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to its conflict-of-law principles. Any dispute that cannot be resolved informally will be brought exclusively before the courts of Islamabad, Pakistan, unless mandatory consumer protection laws in your country of residence give you the right to bring proceedings locally.

You agree to first try to resolve any dispute by contacting us at legal@askzoye.com and giving us a reasonable opportunity to address it.

18. General

These Terms, together with our Privacy Policy and any other policies we link to, are the entire agreement between you and AskZoye regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our written consent; AskZoye may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
